Apple Pay | Terms & Conditions of Use of Edenred Prepaid Cards (United Kingdom) – Apple Pay (“T&Cs”)

Article 1 – Description of the Apple Pay Service

1.1   Apple Pay is a Service provided by Apple Inc. Of One Apple Park Way, Cupertino, CA 95014, USA (“Apple”) that allows users of the Service to perform contactless payment transactions or in-app purchases on a mobile application or merchant site with any of the Apple devices listed in Section 4 below, using pre-paid cards, issued by Edenred UK Limited (based in 50 Vauxhall Bridge Road, London, SW1V 2RS), without having to physically present them.

Article 2 – Terms of Use applicable to the use of the Ticket Restaurant Card, the Incentive Award Cars and the Compliments Card with Apple Pay

2.1   The registration and the use of the Edenred Pre-Paid Cards including, but not limited to, the Ticket Restaurant Card, the Incentive Award Card and the Compliments Card (together “Cards”) constitutes acceptance of these T&Cs. 2.2    In the event of dispute among the Cards T&Cs and these T&Cs, these T&Cs shall prevail.

2.3   Users may remove their Card(s) at any given time from the Service and the aforementioned T&Cs of the Edenred Cards remain applicable.

Article 3 – Commitments of the User

3.1   The User expressly agrees to use the Cards only for his own purposes. The use of the Cards by any third party is strictly prohibited.

3.2   The User expressly undertakes to comply with the provisions of these T&Cs as well as the Apple terms applicable to Apple Pay, available here (these terms are maintained by Apple and Edenred is not responsible for their content).

3.3   It is strongly recommended that the User informs himself regularly of any updates to these T&Cs and the Apple Pay terms of use.

Article 4 – Terms of use of the Service

4.1 To use the Cards, the User must have at the same time:

  • a valid Card;
  • one of the Apple devices listed below, which according to the model will allow the uses described in the table below:

4.1   In order to use the Card, it must be added to the "Wallet" application of iPhone, iPad, MacBook Pro or iPhone's Watch app for use with Apple Watch:

4.1.1    The User must open the "Wallet" application, then click on "Add a credit card" then on "Next" and then manually enter the 16 digits of his Card, his name and the end date, validity period and the visual cryptogram (on the back of the Card).

4.1.2    The User must then read and accept the terms of use.

4.1.3    The User must then enter a verification code that he has obtained by email or by contacting Customer Service at +(44) 333 400 1799, Monday - Friday, 09:00-17:00.

4.1.4    At the end of the above procedure, the User may use the Card, unless Apple or Edenred systems are not responsive.

4.1.5    The User can contact Customer Service at the above telephone number, for further information.

4.2   To make an in-store payment the iPhone's NFC antenna must be active and the User must:

4.2.1    with an iPhone: approach the mobile phone near the contactless payment terminal by holding his finger on the sensor Touch ID of the phone; double-click on the main button when the phone is locked (and if necessary enter the PIN code) to access the "Wallet" application;

4.2.2    with an Apple Watch: keep the Apple Watch near the contactless payment terminal and double-click on the side button.

4.3   To make a payment via an application, the User must select Apple Pay as the payment method and keep his finger on the Touch ID sensor of the iPhone or iPad.

4.4   The User is informed and expressly agrees that any payment transaction via the Service is definitive for validation by himself.

4.5   The use of the Service is free of charge. However, active mobile subscription and internet connection are required, bringing their own charges.

4.6   The User may at any time stop using the Service. To do this, the User must delete the data relating to his Cards in all Apple devices that are using the Apple Pay service.

4.7   In the event of ending the Service, it is expressly agreed that the Cards T&Cs continue to govern the use of the Cards.

Article 5 – Security - Data Processing

5.1 The security rules applicable to the use of the Cards are as follows:

(i) keep your phone/ device/ equipment under surveillance;

(ii) use an adequate and sufficient level of security (e.g. password);

(iii) securely store passwords and Apple and Card PINs;

(iv) use Apple Pay Service in accordance with its updated terms of use;

5.2 The User is expressly informed that in the event of suspension/ blocking of the Cards under the conditions set out in this T&Cs, the Service will no longer be available without the Edenred’s or Apple’s engagement.

5.3 In case of fraudulent use of his Card or loss, the User must:

(i) block his Card as described in these T&Cs

(ii) remove his Card from Apple Pay

In the absence of deletion of the Card in Apple Pay, the Service remains available.

5.4   In case of loss or theft of his Apple device, the User can either go to www.icloud.com/find and then use the "Locate my iPhone" feature to suspend or block payment via Apple Pay from this device. In this case the Service will no longer be available but the Card will be usable in accordance to its own T&Cs.

5.5   Edenred may process the Users’ personal data such as, but not limited to: the User’s first and last name and email address, for the purpose of providing the service. By agreeing to T&Cs of Use, the User agrees to the processing of personal data and agrees with Edenred’s privacy policy, which can be found here.

5.6   Users’ personal data may be forwarded to Edenred affiliates for the purpose of completing the provision of the service described in these T&Cs. In any other case where the transfer of the user's personal data to third parties for any other processing purpose is required, the User will be informed before the relevant transfer.

5.7   Edenred makes every effort to ensure that the information and content of the Site is complete, correct and adequate, but does not guarantee nor assumes any responsibility for the provision, functioning and security of the Service. Consequently, Edenred assumes no responsibility for any damage that the User may suffer as a result of the use of the Service.

Article 6 – Liability / Limits of Liability

6.1   Edenred will perform the necessary verifications and authentications when registering the Cards in Apple Pay.

6.2   Edenred is not responsible for the use of the Apple Pay service and / or any other computer / software equipment made available by Apple, particularly with regards to the performance of the tools or their security.

6.3   Given that the Cards are personal and registered, in accordance with the regulations in force, the User must never allow the use of his Cards and / or Service by any third party.

Article 7 – Miscellaneous

7.1   All Intellectual Property Rights belonging to Edenred and/or Apple shall remain vested in that respective Party. No Intellectual Property Rights shall be transferable or licensable.

7.2   The T&Cs and any documents referred to within constitute the entire agreement between the Parties in respect of the subject matter defined herein and supersedes all prior agreements, negotiations and discussions between the Parties relating to such subject matter.

7.3   No one other than the User shall have any right to enforce any of its terms.

7.4   The failure of a Party to exercise or enforce any right under this Agreement shall not be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.

7.5   Edenred reserves the right to modify these T&Cs at any time.

7.6   This Agreement shall be governed by and construed in all respects in accordance with the laws of England, and the English courts shall have exclusive jurisdiction in all matters relating to this Agreement (whether of a contractual or tortious nature or otherwise).
